Trump's Regime of Consequences and Incentives

The ex-president's voracious urge for payback has swiftly transformed into a methodical apparatus. Within the past year, the president's rage and caprices have adopted the shape of administrative measures in a manner comparable to historical authoritarian systems. Government figures who fail to comply are promptly removed and succeeded by loyalists. Political figures who question him face indictment, court proceedings and sanctions. Adversaries have been labeled under administration memoranda as “unpatriotic”, “opposed to religious values” and “opposing economic freedom”, and warned with prosecution as “security threats”.

The Justice System Restructured

Each situation involving prosecution of Trump's enemies and leniency for loyalists demonstrates its own particular characteristics. Yet, despite their specific nature, they embody manifestations of what has developed as a calculated technique. Such episodes are anything but random. Trump's cleansing of DoJ attorneys and Federal Bureau of Investigation agents, alongside his installation of devotees in high-level posts, began rapidly, quickly developed a consistency, and has now been formed into a structure. Federal prosecutors and the FBI have been remade into ideological agencies under the president's explicit direction to carry out his demands. Injustice has been turned into routine. It constitutes the system of punishment.

Leadership is preoccupied with targeting the President's supposed opponents than they are with defending our country's safety.

Internal the System

The foundation of this system has been revealed in the court filing of three former high-ranking FBI agents filed in September in the federal court in Washington against agency head Kash Patel and attorney general another official for unlawful firing in “a campaign of payback against Plaintiffs for what the accused considered to be a refusal to show sufficient allegiance”. In the complaint that a former acting director, the previous acting FBI director, describes a exchange in which the director “openly confessed the impropriety of his actions”.

Driscoll had tried to defend law enforcement officers from being terminated, the complaint claims. He told him that “they” – interpreted by the official to be the White House and justice department – had instructed him to remove anyone who they determined as having worked on a criminal investigation against Trump. The complaint adds: “He explained that he had to dismiss the individuals his leaders told him to fire, because his chance to retain his own position was contingent on the removal of the officials who worked on matters involving the leader. Patel explained that there was no way he or the official could do to halt these or any other firings, because ‘the agency attempted to put the leader in jail and he remembers.’” After Driscoll told Patel he was breaking the FBI's own policies, the director allegedly said “he knew that and he was aware the nature of the immediate dismissals were almost certainly improper”.

Extensive Consequences

Following the director's reported confession to him, the justice department and the law enforcement agency have been weakened and repurposed for the administration's retribution system. Multiple of the FBI's high-ranking agents were terminated or forced out in the initial period of the presidency. Approximately thousands of professional attorneys at DoJ have taken a “voluntary departure plan”. No fewer than multiple DoJ lawyers, such as those in the Manhattan division, resigned in protest over what they regarded as political interference in abandoning the criminal prosecution against the local official, Eric Adams, in as a trade for his cooperation with his Immigration and Customs Enforcement detentions of foreign nationals. The ethics division of DoJ, which handles ethical violations, has been cut down to minimal staff. The equality section has been severely reduced: seventy percent of its employees has departed. A third of executives at the department have resigned. The section enforcing conservation statutes has lost half its supervisors.

Incentives and Punishments

Concerning the legal matter, the interim prosecutor for the southern district of New York, the official, stepped down in protest against what she described as the “exchange”. The border official, his “enforcement chief,” appeared as the agent with Adams on Fox News to state: “Should he fail to deliver, I will return in the city.”. Additionally, a former official, formerly the acting deputy attorney general and a ex-lawyer, who negotiated the arrangement, was given an court role, a likely pathway to the highest court.

The president's protection for offenses carried out while in power, granted by the unprecedented decision of the Republican majority on the judicial body, thus blocking his criminal case over the Capitol riot and preserving his electoral prospects for the 2024 election, is the cornerstone on which he depends to protect his stalwarts. With such immunity, he has been freed to enable wrongdoing. The consequence of the court judgment saturates his presidency and the Republican Party completely. The court matter has metastasized. In the words of the former president's White House counsel the figure remarked about the Watergate
